Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Timepickr platform, operated by Timepickr ("Timepickr", "we", "us"), a company registered in the Netherlands. By using our website or services, you agree to be bound by these Terms.

1. Definitions

"Platform" refers to the Timepickr website, applications, and related services. "User" refers to any individual or entity that accesses or uses the Platform, whether as a consumer booking appointments or as a business receiving bookings. "Business" refers to a service provider listed on the Platform. "Booking" refers to a reservation or appointment made through the Platform.

2. Use of the Platform

You may use the Platform only for lawful purposes and in accordance with these Terms. You agree not to misuse the Platform, including but not limited to: creating fake bookings, providing false information, interfering with the operation of the Platform, attempting to gain unauthorised access, or using the Platform in a way that could harm Timepickr or other users.

3. Accounts

Business users must create an account to list their services on the Platform. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate, complete, and up-to-date information. Timepickr reserves the right to suspend or terminate accounts that violate these Terms.

4. Bookings and cancellations

Bookings made through the Platform constitute an agreement between the consumer and the Business. Timepickr facilitates this process but is not a party to the agreement between the consumer and the Business. Cancellation policies are set by each Business individually and are displayed at the time of booking. Down payments, where applicable, are subject to the cancellation policy of the Business.

5. Payments

Payments for services are processed through our third-party payment provider. Timepickr does not store full payment card details. Business subscription fees are billed monthly and are due in advance. All prices are exclusive of VAT unless otherwise stated. Timepickr reserves the right to change pricing with 30 days notice.

6. Intellectual property

All content on the Platform, including but not limited to text, graphics, logos, software, and design, is the property of Timepickr or its licensors and is protected by Dutch and international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Platform without prior written consent.

7. Limitation of liability

Timepickr provides the Platform "as is" and "as available". To the maximum extent permitted by Dutch law, Timepickr shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of the Platform. Our total liability for any claim shall not exceed the amount you paid to Timepickr in the 12 months preceding the claim. This does not affect your statutory rights as a consumer under Dutch or EU law.

8. Indemnification

You agree to indemnify and hold harmless Timepickr, its directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Platform, your violation of these Terms, or your violation of any rights of a third party.

9. Termination

Timepickr may suspend or terminate your access to the Platform at any time for violation of these Terms, with or without notice. Business users may cancel their subscription at any time; the cancellation takes effect at the end of the current billing period. Upon termination, your right to use the Platform ceases immediately, but provisions that by their nature should survive termination will remain in effect.

10. Governing law and disputes

These Terms are governed by the laws of the Netherlands. Any disputes arising from these Terms or your use of the Platform shall be submitted to the competent court in Breda, the Netherlands, unless mandatory consumer protection rules provide otherwise.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated via email or a prominent notice on our website at least 30 days before they take effect. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
